In Arizona, FMLA leave is not a paid benefit for employees. Arizona law does not require private employers to provide paid family and medical leave.

The Arizona Family Leave Act, which is similar to the federal FMLA, does not provide paid leave. It only guarantees unpaid leave for eligible employees.

Arizona does offer the Short-Term Family Leave Insurance program, which provides partial wage replacement for eligible employees taking family leave. This program is funded by employee payroll deductions and provides up to 26 weeks of partial pay.

Arizona FMLA Benefits

Arizona FMLA benefits are a bit more complex than you might think. Arizona law requires employers to provide eligible employees with up to 12 weeks of unpaid leave for certain family and medical reasons.

You can take FMLA leave for a serious health condition, the birth or adoption of a child, or to care for a spouse, child, or parent with a serious health condition. This leave is unpaid, but you may be able to use accrued paid time off, vacation, or sick leave to supplement your income.

Arizona FMLA benefits also allow you to take leave for military caregiver leave, which is unpaid, and for qualifying exigency leave, which is also unpaid. These types of leave are designed to support employees who need to care for a family member serving in the military.

The FMLA law applies to employers with 50 or more employees within a 75-mile radius, so not all employers in Arizona are covered. You can check with your HR department or review your employee handbook to see if you're eligible for FMLA benefits.
